Case Spotlight

Last week, the Supreme Court of Puerto Rico ruled in favor of a Mostyn Law client and denied a Petition for Writ of Certiorari filed by One Alliance Insurance Corporation in Caribbean Décor Stone v. One Alliance.
In this case, One Alliance filed a motion for summary judgment based on the doctrine of accord and satisfaction, arguing that the payment issued to our client, Caribbean Décor Stone, had satisfied its insurance claim and, therefore, its lawsuit for Hurricane Maria damages should be dismissed.
After the trial court denied the motion, One Alliance appealed to the Court of Appeals, which, in turn, confirmed the trial court’s decision. One Alliance then went on to the Supreme Court, which last week denied the insurer’s petition.
