JUDGE DENIES DEFENDANTS’ MOTION TO DISMISS PLAINTIFFS’ CLASS ACTION CLAIMS AGAINST FLORIDA INSURANCE COMPANY FOR FRAUDULENT DENIAL AND UNDERPAYMENT OF HURRICANE IRMA CLAIMS

After months of briefing the issues, on May 1, 2020, Judge Jeffrey Levenson of the Seventeenth Judicial Circuit of Florida denied Defendants’ Motion to Dismiss (in its entirety) on Plaintiffs’ claims against Tower Hill Ins. Co. and others for participating in a profit-driven scheme to deny and underpay claims. Last year, Mostyn Law filed a class-action lawsuit on behalf of Florida policyholders who were deprived insurance proceeds after Tower Hill allegedly hired unlicensed adjusters to determine whether or not insureds had damage related to Hurricane Irma. This is a positive development for policyholders in South Florida and Mostyn Law intends to move forward with discovery and secure all evidence necessary to obtain justice for our clients.
