Thirteenth Court of Appeals Upheld Jury’s Finding that USAA Knowingly and Willfully Violated the Insurance Code

Congratulations to Greg Cox, Michael Downey, Brandon Kinard and the Mostyn Law team for the recent victory at the Thirteenth Court of Appeals in USAA v. Griffith!

The Court of Appeals found that there was sufficient evidence to uphold the jury’s finding that USAA knowingly and willfully violated the Texas Insurance Code based on USAA’s inadequate investigation of hail damage to our client’s roof. Specifically, the Court of Appeals affirmed that USAA breached the insurance policy, USAA’s conduct constituted bad faith, USAA knowingly violated the Texas Insurance Code, USAA did not comply with the Prompt Payment of Claims Act, and USAA must pay our client’s attorney’s fees.
